How does it work?

1. Place and pay for an order of any of the Samsung TVs listed above before stock runs out or 23:59 on Friday, 25 October 2019, whichever comes first.

2. Sit back, try to relax, and support South Africa’s rugby campaign to win the World Cup Final on Saturday, 2 November 2019.

3. If South Africa wins the rugby final on the 2nd of November 2019, takealot.com will automatically credit all eligible participants the full value of the purchasing price of their selected Samsung TV to their Takealot accounts withing 10 days.

Important:

a). This promotion only applies to selected Samsung TVs (as listed above).

b). The selected Samsung TVs will be available for purchase on takealot.com on a first-come, first-served basis and while promotional stocks last or until 23:59 on Friday, 25 October 2019, whichever comes first.

c). A promotion-specific returns policy applies to the selected Samsung TVs and the standard 30-day Takealot Returns Policy does not apply to them.

d). Samsung TVs bought as part of this promotion may only be returned within 7 days after taking delivery. Thereafter the products may only be returned if they are faulty or defective, in which case the standard Takealot Returns Policy will apply.

#BackTheBucks Samsung TV Promotion: Terms and Conditions 

Purchase a selected Samsung TV on takealot.com and stand a chance to be refunded in full if the South African men’s rugby team (the “Springboks”) win the World Cup Final on 2 November 2019.

IMPORTANT: Please note that this promotion only applies to selected Samsung TVs. The relevant Samsung TVs (listed below) will be available for purchase on takealot.com, (i) on a first-come, first-serve basis, (ii) while promotional stocks last and (iii) are subject to the promotion-specific returns policy set out below.

1. Promoter: This promotion is run by Takealot Online (RF) (Pty) Ltd (reg. no. 2010/020248/07) (“takealot.com”, “Takealot” “us”, “we” or “our”).

2. Promotion Period: This promotion runs from 00h01 on the 6th of September 2019 until (i)  the allocated promotional stock has sold out or, (ii) 11:59 on the 25th of October, 2019, whichever occurs first  (the “Promotion Period”). Purchases of the selected Samsung TVs made outside of the Promotion Period will not be subject to this promotion.

3. Who can participate: You are entitled to participate in this promotion if (i) you are a natural person who is at least 18 years old and who resides in South Africa; and (ii) your purchase was made using a valid TV license. You may NOT participate if you are a supplier of goods or services in connection with this promotion, or if you are a third-party making use of the takealot.com marketplace platform,  or if you are any of the aforementioned persons’ spouse, life partner, parent, child, brother, sister or business partner.

4. How to participate:  This promotion is run on www.takealot.com, its related mobi-sites and software applications (the “Website”). To participate you need to place a successful order and pay for any one of the three selected Samsung TVs listed in clause 5 below during the Promotional Period. Your successful order of one of the selected Samsung TVs constitutes a single entry and you may enter as many times as you wish.

5. Promotional Products: You must purchase one of the following TVs to participate in this promotion, namely:

Promotional stock is limited and will be available on a first-come-first-served basis.

6. The Refund: If the Springboks win the 2019 World Cup rugby final, Takealot will refund all eligible participants the full value of the promotional purchasing price of the selected Samsung TV. The refund will be processed by way of a credit to the participants’ takealot.com account.  Credit refunds will be processed within 10 working days after the 2nd of November 2019 and confirmed with successful participants via email.  Where a participant does not wish to receive the refund in the form of takealot.com credit, s/he may indicate so by replying to the notification email, whereafter the refund will be processed according to the participant’s original payment method.  For the avoidance of doubt, should the Springboks not win the World Cup rugby final on 2 November 2019 no refunds will be processed.

7. Returns: This returns policy applies to the selected Samsung TVs purchased during the Promotion Period. For the avoidance of doubt, Takealot’s standard returns policy does not apply to the selected Samsung TVs.

7.1. Unwanted Products: You can return an unwanted Samsung TV purchased during the Promotion Period to us at no charge provided that:

a) you log a return on the Website within 7 (seven) days of delivery to you or collection by you of the unwanted TV. After 7 (seven) days you can only return the TV if it is defective;

b) it is undamaged and unused, with the original labels and stickers still attached;

c) it is in the original packaging, which must be undamaged and in its original condition with all seals still intact (if applicable); and

d) it is not missing any accessories or parts.

7.2. Not what you ordered: If we accidentally deliver the wrong product to you, or if the product is not as described on the Website, please notify us and we will collect the product from you at no charge. If the product is missing any accessories or parts, you will need to follow the process set out in section 7.3 below. Once we have inspected the product and validated your return, we will at your choice deliver the correct product to you as soon as possible (if the correct product is available); or credit your account with the purchase price of the product within 10 days of the return (or refund you if that is your preference).

7.3. Products damaged on delivery: Should a product be damaged or missing any parts or accessories at the time of  delivery, please notify us within 7 days of such delivery / collection by logging a return on the Website. We will arrange to collect the product from you at no charge. Once we have inspected the product and validated your return, we will at your choice repair / replace the product as soon as possible (if such repair is possible/ we have the same product in stock to use as a replacement) or credit your account with the purchase price of the product (or refund you if that is your preference).

7.4. Defective products: We do our best to ensure that the products we deliver to you are of a high quality,  and in good working order and without defects.

What is a defect? A defect is a material imperfection in the manufacture of a product or any characteristic of a product, which makes the product less acceptable than one would reasonably be entitled to expect in the circumstances. Please refer to our FAQs for some examples. The following will NOT be regarded as defects and will not entitle you to a return under this clause 7.4:

a) faults resulting from normal wear and tear;

b) damage arising from negligence, user abuse or incorrect usage of the product; damage arising from electrical surges or sea air corrosion;

c) damage arising from a failure to adequately care for the product;

d) damage arising from unauthorized alterations to the product;

e) where the specifications of a product, although accurately described on the Website and generally fit for its intended purpose, do not suit you; and

f) in relation to Unboxed Deals or used products, signs of handling and/or repackaging.

7.5. Preparing your product for return: To ensure your request is processed as quickly as possible you are responsible for the following when returning your products:

a) package your products safely and securely for protection during transit;

b) clearly mark your return reference number on the outside of the parcel; and

c) include all accessories and parts that were sold with the product.

Failure to adhere to any of these requirements could delay the processing of your request or result in its decline altogether.

Save for the Takealot’s standard Returns Policy (which is replaced by the promotional returns policy set out above), the remaining provisions of Takealot’s standard Website Terms and Conditions, the TVs Standard Product Warranty and the Extended Supplier Warranty in respect thereof shall apply to all TVs purchased in terms of this promotion.

8. Disqualification: There are certain situations in which a participant will be disqualified from receipt of the promotional refund offer, namely: (i) he/she fails to successfully pay for their promotional order during the promotion period; (ii) he/she is found to have contravened any other rule set out herein. In the event of disqualification of a participant, we will be entitled in our sole discretion to not offer the promotional refund.

9. Unforeseen events: In the event of unforeseen circumstances or causes beyond our reasonable control (including but not limited to the accessibility and function of the Website or the 2019 World Cup being suspended or cancelled), we reserve the right to cancel this promotion, to change the number or nature of the promotional products at any time, or to change the rules at our discretion (provided that we will not change the conditions for participation or conditions for being awarded the promotion, as stated herein). In the event of the promotion being cancelled, any promotional items bought at that time may be returned subject to our returns policy, as read with the provisions of these Terms and Conditions.

10. Rules: By participating in this promotion, you agree to all the promotional rules set out above, without exception.
